Schedule 1 — Deposit Terms & Conditions (Vehicle Reservation Deposits)
This Schedule forms part of the Sure Automotive Ltd Terms & Conditions pack.
1) Definitions
- “We / us / our” = Sure Automotive Ltd
- “You / your” = the customer paying the deposit
- “Vehicle” = the specific vehicle shown on your invoice/order document
- “Deposit” = the amount shown on your invoice/receipt paid to reserve the Vehicle
2) What the deposit does
2.1 The Deposit is a reservation/holding payment to temporarily remove the Vehicle from sale (or pause advertising) while you progress to purchase.
2.2 The Deposit becomes part-payment of the Vehicle price if you complete the purchase.
2.3 Unless we confirm a different period in writing, the standard reservation period is 5 calendar days from the time we confirm cleared funds.
3) How deposits must be paid (important)
3.1 Deposits must be paid only by:
- our Invoice/payment link (card or bank transfer), or
- bank transfer to the Sure Automotive Ltd business account shown on your invoice.
3.2 We do not accept deposits paid to any personal account. If you are asked to pay a deposit to a personal account, do not pay it and contact us immediately at contact@sure-automotive.com.
3.3 We may request ID and proof of address before confirming or refunding a Deposit.
4) When a contract is formed
4.1 Paying a Deposit does not automatically mean a final sales contract is formed.
4.2 A binding sales contract is normally formed when you sign/confirm the vehicle order form/retail agreement and any required checks are completed.
5) If you proceed with the purchase
5.1 The Deposit is deducted from the final balance due.
5.2 The Deposit is linked to the specific Vehicle and is not transferable unless we agree in writing.
6) When we refund the deposit in full
We will refund your Deposit in full if:
6.1 We cannot supply the Vehicle.
6.2 The Vehicle fails an agreed pre-sale check we told you we would complete and you choose not to proceed.
6.3 The Vehicle is materially different from what we described to you before you paid the Deposit and you choose not to proceed.
6.4 Finance is declined after a full and honest application (accurate information and documents provided).
Refunds are made to the original payment method where possible.
7) If you cancel (change of mind)
7.1 If you cancel for a reason not listed in section 6, we may retain only the amount needed to cover our reasonable costs caused by your cancellation (up to the value of the Deposit) and refund any remaining balance.
7.2 Reasonable costs may include admin/payment processing, agreed preparation already carried out (valet/workshop/parts), inspection costs, transport arranged for you, and re-listing/remarketing costs.
7.3 If we retain any amount, we will explain what it covers. If costs are less than the Deposit, we refund the difference.
8) Distance sales (online/phone/email)
8.1 If the transaction is agreed entirely at a distance and the Vehicle is delivered to you, cancellation rights may apply depending on the circumstances.
8.2 If cancellation is valid after delivery, you must keep the Vehicle safe and make it available for return/collection as agreed. Reasonable deductions/return costs may apply where permitted and disclosed.
8.3 Where cancellation is accepted under this section, we refund the Deposit as part of the overall refund once the Vehicle is returned/collected and checked.
9) Part-exchange and deposits
9.1 Any part-exchange valuation given before inspection is provisional.
9.2 If the part-exchange value changes after inspection, you may accept the revised valuation or cancel the reservation.
9.3 If you cancel solely due to a valuation change, the Deposit will be handled under section 6 unless the change is due to undisclosed issues (condition, warning lights, mileage discrepancy, accident damage, missing items).
10) Complaints
Email contact@sure-automotive.com with your name, vehicle reg (if known), invoice/reference number, and what resolution you want.
11) Governing law
These Deposit Terms are governed by the laws of England and Wales.
